Key terms — please read before you accept

This summary is also shown on the acceptance screen in the app. It is part of the Terms but does not replace the full text below.

  1. Businesses only. The service is for store owners acting as a business, not for consumers (s. 1).
  2. "As is". No promise that the service suits every store, runs without errors or achieves any business result (s. 9).
  3. Blink is not a law firm. Legal documents, the accessibility statement and privacy settings the app prepares are drafts only. Reviewing them (ideally with a lawyer), adapting and publishing them is your responsibility (s. 5.2).
  4. Accessibility is solely your responsibility. The accessibility widget is an aid and does not make your site accessible (s. 5.3).
  5. You are responsible for everything shown in your store: content, reviews (including your right to use reviews you import), prices and price tests, and AI-generated content (ss. 5–7).
  6. Limitation of liability. Our total liability is limited to what you paid us in the 12 months before the event, and we are not liable for indirect or consequential damage or lost profits, revenue or data — to the extent the law allows (s. 10).
  7. Indemnity. You indemnify us against third-party claims arising from your store, your content or your breach (s. 11).
  8. Billing through Shopify; cancel any time by uninstalling (s. 4).
  9. Changes to the Terms — with at least 30 days' notice and the option to stop before they apply (s. 14).
  10. Israeli law; exclusive jurisdiction of the courts of Tel Aviv-Yafo. No arbitration (s. 13).

1. What this agreement covers, and who is a party

1.1. These Terms govern the use of the Blink One app ("the App") installed in a Shopify store, its storefront extensions (Theme App Extension, thank-you and checkout extensions, Shopify Functions, Web Pixel), the Claude connection consent page and any service we provide through it ("the Service").

1.2. "Merchant" or "you" = the store owner who installed the App, and anyone acting on its behalf in the Shopify admin (staff, partners, freelancers, agencies). Their actions count as yours.

1.3. Business use only. You confirm you install and use the App for a business (as a business, not as a consumer) and that you are authorised to bind the business. Price and the allocation of liability in these Terms are based on this.

1.4. How you accept. The first time you open the App (and whenever the Terms version changes) a screen shows the key terms, links to the full Terms and Privacy Policy, an unticked checkbox ("I have read and agree") and an "I agree to the Terms" button. The App does not open without acceptance. We keep a record of it: shop domain, Terms version, language, a hash of the text shown, the time, and the Shopify user id when Shopify provides it. The record is evidence of your acceptance, and you agree it may be used as such.

1.5. These Terms include the Privacy Policy (linked from the App and from the Blink One App Store listing), the Data Processing Addendum (DPA) and the AI and price-test disclosure. Shopify's terms (Terms of Service, Partner Program, Acceptable Use Policy) also apply to you. If there is a conflict about billing, Shopify's billing rules prevail.

1.6. You confirm you had the opportunity to read the Terms and to consult a lawyer before accepting.

2. Licence

2.1. While you comply with these Terms and have an active plan (or trial), we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to use the App for the store it is installed in.

2.2. All rights in the App, code, design, document templates, text libraries, the "Blink" name and our trademarks are reserved. Nothing here transfers ownership.

2.3. You may not: copy, decompile, reverse-engineer or clone the App; circumvent plan, permission or safety limits; use the Service to build a competing product; sell or rent access to the Service.

3. Your content and data

3.1. Your store's content — products, texts, images, reviews, business details, documents — stays yours.

3.2. You allow us to use that content only to provide the Service (e.g. to build test versions, draft a document, translate a review), as described in the Privacy Policy.

3.3. Texts the App generates for you (including AI-generated text) — to the extent they carry rights, those rights pass to you. We have no exclusivity, and similar text may be generated for other merchants. We do not promise that they are protected by copyright or unlike others' content.

3.4. We may use aggregated, anonymous data (that does not identify you, your store or a customer) to improve the Service. We never sell data and never use your content or your customers' data to train AI models.

4. Plans, trial and billing

4.1. Billing runs only through Shopify's billing system (Shopify App Pricing) and appears on your Shopify invoice. We never see or store card details.

4.2. Current plans: Starter, Pro and Max, at the prices shown on Shopify's plan page and on the App's listing. The binding price is the one on Shopify's approval page when you subscribe.

4.3. Trial: as shown on Shopify's approval page and managed by Shopify. Shopify counts trial days across uninstall and reinstall, so reinstalling does not necessarily start a new trial.

4.4. Billing cycle: every 30 days, in advance, from the end of the trial.

4.5. Plan changes: upgrades, downgrades and cancellation happen on Shopify's plan page; mid-cycle proration follows Shopify's rules.

4.6. Cancellation: any time, on the plan page or by uninstalling. Billing stops from the next cycle.

Refunds: we do not refund a billing cycle that has started, unless the law requires it, Shopify decides otherwise, or we stopped the Service for a reason other than your breach (s. 12.4). If you were charged by mistake, write to schoolblinkecom@gmail.com; if the mistake is ours we refund through Shopify.

4.7. Price changes: announced at least 30 days in advance in the App or by email. A change never applies to a cycle already paid. If you disagree, cancel before it takes effect, without penalty.

4.8. Perks (e.g. a free month for Blink training members): granted at our discretion as a Shopify trial extension. Not a contractual right; we may stop granting it going forward.

4.9. Development stores get free access for testing only.

4.10. Taxes follow Shopify's tax rules.

5. Your responsibilities

5.1. Store content — your sole responsibility. Everything shown in your store — products, prices, marketing claims, trust badges, announcement bar, WhatsApp text, reviews, documents, texts created with the App — is your responsibility. You are responsible for it being accurate, not misleading and lawful (including consumer-protection, advertising, copyright and trademark law). The App provides tools; what you publish is your decision.

5.2. Legal documents the App prepares — drafts only. Terms, privacy policy, cancellation and returns, shipping, cookies, accessibility statement, cancellation page and form — all are general drafts, not reviewed by a lawyer and not tailored to your business. Blink is software, not a law firm, and gives no legal advice; nothing in the App, the documents, the explanations or support is legal advice or creates a lawyer–client relationship. Before using these tools you accept a separate disclaimer to that effect (stored with its version and time). You are responsible for reviewing every document (ideally with a lawyer) before publishing, filling in your details correctly, updating it when your business or the law changes, and actually doing what it says. We are not responsible for any document being lawful or suitable for your business.

5.3. Accessibility — your sole responsibility. The duty to make your site accessible, to the extent it applies to you (Israel's Equal Rights for Persons with Disabilities Law, 1998; the Equal Rights for Persons with Disabilities (Service Accessibility Adjustments) Regulations, 2013, in particular regs. 35–35F; Israeli Standard IS 5568, based on WCAG; and foreign laws if you sell abroad) — rests with you alone. The accessibility widget, automatic fixes, alt-text audit and checklist are aids only: they do not make the site accessible, do not guarantee compliance with any standard or regulation, and do not replace an audit by a certified accessibility professional. The accessibility statement the App prepares is a draft; the level of accessibility you declare in it, the coordinator's details and handling requests are your responsibility. We are not liable for any claim, compensation (including compensation without proof of damage under s. 19נא of the Law) or cost arising from your site's accessibility.

5.4. Payment logos and trust badges: show only payment methods you actually accept and only promises (shipping, returns, warranty, "secure checkout") you keep. Logos are their owners' trademarks.

5.5. Reviews.

(a) You are responsible for every review you add, import or publish being genuine, for having the right to use it (text and photos), for it relating to the product you sell, and for its source being shown fairly. You may not write or commission fake reviews, filter negative reviews in a way that gives a misleading picture, or mark "Verified buyer" without a real purchase.

(b) Import from a file or from a product-page link: Blink only provides a technical tool. Before every import you confirm, by ticking a box, that you have the right to use the reviews and that they relate to the product you sell; the confirmation is recorded (version, time, product id). You warrant it is true.

(c) Reviews imported from a supplier's product-page link are always shown with the label "Review from the supplier's marketplace", under a generic display name without the buyer's name, never as "Verified buyer" and never in Google structured data. You may not circumvent or hide this label (e.g. with CSS or manual copying) or present such reviews as written by your store's customers.

(d) You are responsible for complying with the terms of the site the reviews come from, with the copyright of their authors and photographers, and with the consumer law that applies to you — in Israel (no misleading, s. 2 of the Consumer Protection Law) and where you sell (e.g. in the US: the FTC rule on consumer reviews, 16 CFR Part 465).

(e) We may limit, disable or remove the link-import tool at any time (e.g. if the source site asks, if its robots.txt forbids it, or on legal concern), and that is not a breach.

5.6. Experiments and price tests: you decide whether to run experiments, what share of traffic to risk, whether to run price tests, in which markets and whether to auto-approve versions. You are responsible for complying with price-display, sales and discount law (including Israel's Consumer Protection Law and its regulations, and the laws where you sell) and for the customer paying the price shown. See s. 7.

5.7. Your customers' privacy: you are the controller of your customers' data ("database controller" under Israel's Privacy Protection Law after Amendment 13; Controller under the GDPR). You are responsible for your own privacy policy, consents (cookies, marketing) and answering customer requests. For customer data passing through us we act on your behalf ("holder" / Processor) under the DPA.

5.8. External connections: the Meta connection, the Claude connection and third-party services are subject to their own terms and your account with them. We are not responsible for third-party services, their changes or their discontinuation.

5.9. Backup: approved reviews are stored in your Shopify store and are deleted by Shopify on uninstall. Export them (CSV) before uninstalling. You are responsible for backing up content that matters to you.

5.10. Check after enabling: after enabling any tool, and after any theme or other-app change, check your store (including mobile and checkout). We do not control your theme or other apps.

6. Prohibited use

You may not use the Service to: mislead consumers (a price that isn't charged, fake urgency, fake reviews, hiding a review's source); infringe others' rights; collect customer data unlawfully; circumvent the App's safeguards (such as price-test limits, source labels, rate limits or text filters); overload or attack our servers; or run the App in a store selling illegal products or services.

7. AI and the optimization tree

7.1. Some tools use Anthropic's Claude models (server-side): writing text and page versions for experiments, and translating reviews. AI output can be wrong, inaccurate, unsuitable, misleading or similar to existing content. We have filters (e.g. a number not in the source is rejected, fake-urgency words are rejected), but they guarantee nothing. You are responsible for checking every output before customers see it.

7.2. By default every AI-written version waits for your approval before customers see it. If you enable "Claude versions go live without waiting for approval", you waive that check and bear full responsibility for the content shown.

7.3. Price tests are off by default and open only if you enable them and approve the discounts permission. The App is built so the customer pays the price shown (a Shopify automatic discount), but:

(a) showing different prices to different customers may be regulated in some countries and require disclosure;

(b) what is actually shown depends on the theme, other apps, "Buy now" buttons and customer login at checkout;

(c) when you announce a sale after a price test, the "price before the sale" must also be measured against the test prices. You are responsible for checking your store after enabling, choosing the markets where price tests run, and honouring the lower price when in doubt (the App generates a difference code for that).

7.4. Experiment results (probability, "profit per month", etc.) are statistical estimates, not a promise of any business result.

8. Availability, changes and beta

8.1. We make reasonable efforts to keep the Service available but do not promise continuous availability or any service level (SLA). Shopify, Anthropic, Meta, the hosting provider and other services may disable parts of it.

8.2. Tools marked "beta" or "experimental" are provided as is and may change or close.

8.3. We may improve, change, add or remove features. If we remove a core feature of your plan we give 30 days' notice (or as early as possible if the cause is external — Shopify, a vendor, the law), and you may cancel without penalty.

9. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent the law allows we give no representation or warranty — express or implied — of fitness for a particular purpose, merchantability, non-infringement, legal compliance (including consumer, privacy, accessibility, price display), accuracy of AI output or documents, business results (sales, conversions, profit, Google ranking), or error-free or uninterrupted operation. You are responsible for checking your store after each change (there is a built-in scanner). Checkout is operated by Shopify.

10. Limitation of liability

10.1. Damages we do not bear. To the maximum extent the law allows, we are not liable for indirect, consequential, special, incidental or punitive damage; for loss of profits, revenue, sales, business opportunities, goodwill or data; for fines, penalties or damages awarded against you; or for claims by your customers or third parties against you — under any theory (contract, tort, negligence or otherwise), even if told of the possibility.

10.2. Cap. Our total, aggregate liability for all claims together will not exceed the amount you actually paid us (through Shopify) in the 12 months before the first event giving rise to liability.

10.3. Why this is reasonable. The Service's price reflects this allocation of risk: it is relatively cheap, provided to many stores, and we do not control your content, theme, decisions or products — you do, and you can insure your business. Without this limit the price would be much higher.

10.4. What is not limited. Nothing in these Terms limits liability that may not be limited by law, in particular for bodily injury, or for damage caused by our wilful misconduct, fraud or gross negligence.

11. Indemnity

11.1. You will indemnify and hold harmless us (and our owners, employees and contractors) against any claim, demand, proceeding, fine, penalty, damages or reasonable cost (including reasonable legal fees) arising from: (a) your store, products and content (including documents, the accessibility statement, reviews — imported ones too, trust badges, prices and price tests, and AI text you published or allowed to publish automatically); (b) your site's accessibility; (c) your use of the Service in breach of these Terms or the law; (d) infringement of third-party rights by you or anyone acting for you; (e) an untrue confirmation you gave (e.g. about your right to use reviews).

11.2. The indemnity does not apply to the extent the damage was caused by our breach of these Terms or our wilful misconduct or gross negligence.

11.3. We will notify you promptly of a claim, let you take part in the defence, and not settle on your behalf without your consent (not to be unreasonably withheld).

12. Suspension and termination

12.1. You may stop at any time by uninstalling the App.

12.2. Immediate suspension (of a store, a tool or the whole Service) is allowed only where reasonable in the circumstances: breach of these Terms, Shopify's terms or the law; a real risk of harm to customers, third parties, security or the Service's stability; a demand by Shopify, an authority or a court; or non-payment. We will tell you about the suspension and its reason and restore the Service once the reason is removed.

12.3. Termination for breach: if the breach can be cured, we notify you and allow 14 days to cure before terminating (unless the case is urgent as in s. 12.2).

12.4. Termination for any other reason: on at least 30 days' notice. In that case we refund, through Shopify, the unused pro-rata part of a paid billing cycle.

12.5. After uninstall: storefront components are removed by Shopify; your data with us is deleted as described in the Privacy Policy, except the consent records (ss. 1.4 and 5.5(b)), kept as evidence. Sections 3, 5, 9, 10, 11, 12.5, 13 and 15 survive termination.

13. Governing law and jurisdiction

13.1. These Terms and every matter relating to the Service are governed solely by the laws of the State of Israel (without conflict-of-law rules).

13.2. The competent courts of the Tel Aviv-Yafo district have exclusive jurisdiction. No arbitration.

13.3. Before filing a claim, each party will write to the other and allow 30 days to try to resolve the dispute — without prejudice to seeking urgent relief.

14. Changes to these Terms

14.1. We may update the Terms for reasonable reasons: changes in the Service, the law, Shopify's requirements or vendors, or to improve clarity.

14.2. We announce a material change 30 days in advance in the App and by email to the store owner's address provided by Shopify. The new Terms are presented on the acceptance screen, and the App will not keep working for you without acceptance. If you disagree, uninstall before the change date; uninstalling carries no penalty and a cycle already paid is not affected to your detriment.

14.3. A change required by law, by Shopify or for security may take effect sooner; we announce it as soon as possible.

14.4. A change never applies retroactively to an event that happened before it took effect.

15. General

15.1. Assignment: you may not assign this agreement without our consent; we may assign it to an entity that takes over the Service in a merger, acquisition or sale, with notice to you.

15.2. Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control (including outages of Shopify, cloud or AI vendors, war, cyber-attack, an authority's order).

15.3. Notices: to us — schoolblinkecom@gmail.com. To you — in the App and/or to the store owner's email as provided by Shopify.

15.4. No waiver by delay or indulgence. A provision struck or modified by a court is adjusted to the minimum extent necessary; the rest stays in force.

15.5. This agreement (with the Privacy Policy, DPA and AI disclosure) is the entire agreement about the Service.

15.6. Language: the Hebrew text is binding; this English text is a convenience translation.
